Alexander Strachan and Anne Stephen (the only child of the marriage between Anne Mudie and Robert Stephen) got married and Mr. Stephen became bound to pay some money to Mr. Strachan "in name of dote and tocher". The marriage of Anne's parents was dissolved by the death of her mother. Her father (Robert Stephen) married again to Jean Straiton. Robert executed a will to appointed his wife a "universal legatrix." This document superseded a deed where he disponed his lands of Letham, his house in Montrose, among another things. The pursuers brought this action against Robert's widow to ask for the payment of portion that Anne is entitled as heir of Robert (Legitim or bairn's part of gear).
