George Ross and Others v. Sir Roderick M'Kenzie and Others

In 1772, the Commissioners of Supply divided certain cumulo valuations in the county of Inverness. On the basis of these divisions, Sir Roderick Mackenzie of Scatwell, and others, sought to be enrolled as freeholders of the county. However, the existing freeholders refused their claims, citing objections to the divisions. The court ordered a hearing on two legal questions: (1) whether the Court of Session had jurisdiction to review the Commission’s valuation proceedings; and (2) whether the freeholders were entitled to challenge decrees of division.
